The Disaster Management Directorate General may conduct official inspections throughout the country, not only after prior notification, but also on a random basis, whether at workplaces, office buildings, or even apartment buildings. If deficiencies are found during the inspection, the owner may be required to take immediate action and may also be fined between 20,000 and 10,000,000 forints. In this series of articles, we would like to highlight some of the deficiencies that we have regularly encountered during our decades of fire and occupational safety work and continue to encounter to this day.<\/p>\n\n\n\n

When does an employer need to hire a fire safety instructor or chief instructor, and what are their responsibilities?<\/h1>\n\n\n\n

A question that often arises in business organizations is what qualifications the law requires for the employment\/appointment of a fire safety specialist, taking into account the specific facility and activity. Decree 9\/2015. (III. 25.) BM specifies in detail the cases in which the employer is required to employ or commission a specialist with intermediate (lecturer) or advanced (senior lecturer) qualifications. The tasks of a fire safety specialist may include:<\/p>\n\n\n\n

\u00b7 Drafting and updating fire safety regulations.<\/p>\n\n\n\n

\u00b7 Preliminary and recurring mandatory fire safety training for employees and new hires.<\/p>\n\n\n\n

\u00b7 Monitoring the inspection, repair, or replacement of fire safety equipment.<\/p>\n\n\n\n

\u00b7 Fire safety inspections, consultations, conducting inspections, preparing reports on inspections,<\/p>\n\n\n\n

\u00b7 Preparing organizational units for official inspections.<\/p>\n\n\n\n

\u00b7 Representing the client's interests during official inspections.<\/p>\n\n\n\n

\u00b7 Liaison with fire authorities.<\/p>\n\n\n\n

\u00b7 Participation in the investigation of fire incidents.<\/p>\n\n\n\n

\u00b7 Developing new solutions for prevention.<\/p>\n\n\n\n

9\/2015. (III. 25.) BM Decree 7. \u00a7 (1) At least one person with intermediate-level fire safety qualifications must be employed or commissioned for a minimum of 8 hours per month among those employed in the fire safety sector at economic organizations if:<\/p>\n\n\n\n

a) the economic operator produces, processes, or stores substances classified as explosive, and the total quantity of substances produced, processed, or stored at a single site exceeds 1,000 kg or 1,000 liters, but does not exceed 5,000 kg or 5,000 liters, with the exception of economic operators operating fuel filling stations,<\/p>\n\n\n\n

b) the economic operator stores substances or products classified as flammable, and the total floor space used for outdoor and indoor storage at a single site exceeds 1,000 m2 but does not exceed 10,000 m2, or<\/p>\n\n\n\n

d) the economic operator operates or leases a part of a building or a building,<\/p>\n\n\n\n

da) in which there is a room intended for mass gatherings with a capacity of up to 500 people,<\/p>\n\n\n\n

db) with a total capacity exceeding 500 persons but not exceeding 2,000 persons, or<\/p>\n\n\n\n

dc) in which persons with limited mobility are accommodated, cared for, treated, educated, taught, and looked after, and the number of such persons exceeds 20 but does not exceed 100.<\/p>\n\n\n\n

(2) Among those employed in the fire protection sector at economic organizations, persons with advanced fire protection qualifications must be employed or commissioned in the following cases:<\/p>\n\n\n\n

a) the economic operator is obliged to operate a full-time fire brigade at its premises,<\/p>\n\n\n\n

b) the economic operator produces, processes, or stores substances classified as explosive, and the total quantity of substances produced, processed, or stored at a single site exceeds 5,000 kg or 5,000 liters, with the exception of economic operators operating fuel filling stations;,<\/p>\n\n\n\n

c) the economic operator stores materials or products classified as flammable, and the total floor space used for outdoor and indoor storage at a single site exceeds 10,000 m2, or<\/p>\n\n\n\n

d) the economic operator operates or leases a part of a building or a building,<\/p>\n\n\n\n

da) which has a room with a capacity of more than 500 people,<\/p>\n\n\n\n

(b) with a total capacity exceeding 2,000 persons, or<\/p>\n\n\n\n

dc) in which persons restricted in their freedom of movement are accommodated, cared for, treated, educated, taught, or looked after, and the number of such persons exceeds 100 at any one time.<\/p>\n\n\n\n

The regulation also specifies the level of qualification required to perform certain fire safety activities (preparation of fire safety training materials and fire safety regulations).<\/p>\n\n\n\n

9\/2015. (III. 25.) BM Decree 7. \u00a7 (6) In the case of a business entity employing more than five employees, including family members participating in the work, or operating premises suitable for accommodating more than fifty people, where the decree requires the employment of a person with intermediate-level fire safety qualifications, the fire safety training curriculum may be prepared by a person with at least an intermediate level of fire safety qualification. In cases where the legislation requires the employment of a person with an advanced level of fire safety qualification, the fire safety training curriculum may only be prepared by a person with an advanced level of fire safety qualification.<\/p>\n\n\n\n

(7) Fire safety regulations may be drawn up and amended by persons with at least an intermediate level of fire safety qualification. In cases where legislation requires the employment of persons with a higher level of fire safety qualification, persons with a higher level of fire safety qualification shall be authorized to draw up and amend fire safety regulations.<\/p>\n\n\n\n
