Information on changes to occupational safety rules relating to remote working
Government Decree 487/2020 (XI.11.) was published in issue 244 of the Hungarian Gazette (November 11, 2020), which deals with the application of rules relating to teleworking during the state of emergency, among other things. Exercising its emergency powers due to the second wave of the Covid-SARS 2 coronavirus, the government has taken the following measures:
- § (1) Different application of the provisions of Act XCIII of 1993 on occupational safety § 1 (1) During the state of emergency declared in Government Decree 478/2020. (XI. 3.) on the declaration of a state of emergency (hereinafter: state of emergency), Section 86/A of Act XCIII of 1993 on occupational safety shall not apply.
Based on the issued provision, this means that during the declared state of emergency, employers are exempt from the risk assessment tasks and obligations set out in Section 86/A of Act XCIII of 1993 (Occupational Safety Act) and specified in Section 54 of the Act.
However, we would like to draw our Partners' attention to the fact that once the emergency situation has ended, this obligation will automatically be reinstated, regardless of when the employee started working remotely (retroactive effect)!
1.§ (2) In the case of teleworking, the employer shall inform the employee of the rules governing working conditions that are necessary for the performance of work and that do not pose a risk to health and safety, and the employee shall choose the place of work with regard to the fulfillment of these working conditions.
